Summary

The facility failed to provide the required level of assistance with eating for one resident. The resident had diagnoses including adult failure to thrive, dysphagia, gastro-esophageal reflux disease, and unspecified protein-calorie malnutrition. A significant change MDS showed a BIMS score of 6, indicating severe cognitive impairment, and the MDS indicated the resident required partial to moderate assistance with eating. The care plan directed staff to set up meals and assist as needed, and occupational therapy documented that the resident required increased assistance with meals by mouth and was changed to RED level assist. Facility policy and meal assist guidelines stated that residents needing physical assistance with meals were to be assigned RED level assist, while YELLOW level assist was for intermittent supervision and verbal cues. The resident’s dietary orders also listed RED level assist. However, the resident’s meal tray card on the unit indicated YELLOW assist instead of RED assist. Staff stated they used the tray card to determine the level of help needed, and the RN, RD, DON, and Administrator all confirmed the tray card did not match the resident’s order and should have reflected RED assist. During observations, the resident was seen eating lunch without staff present in the room. On one occasion, the resident was in bed feeding themself lunch with no staff present. On another occasion, a CNA entered, provided meal set-up, and then left the room, after which the resident was again observed eating with no staff present. Staff interviews showed the CNA believed the resident was YELLOW assist and that YELLOW meant opening items and returning later, while the RN and other leadership staff stated the resident should have been RED assist and that RED required staff to stay with and assist the resident throughout the meal.
