At 10:07 a.m. the same day, the surveyor and the Housekeeping Supervisor again observed the dumpster area in the same condition, with foul odor, open lids, and scattered trash. The Housekeeping Supervisor stated that the dumpster area should be cleaned more than daily and acknowledged that leaving trash and lids open is not good and can attract cats, varmints, and rodents. The facility’s waste management policy dated 5/14 requires that plastic liners be tied and placed in outside dumpsters with lids kept closed, and that Maintenance and Housekeeping personnel ensure the dumpster area is kept clean, all trash bags are inside the dumpster, and dumpster lids are closed. This deficiency had the potential to affect all 213 residents residing at the facility, as the improper disposal and management of garbage and refuse occurred in a shared environmental area intended to prevent the spread of infection.

The MS stated he and his assistant were responsible for keeping the dumpster area clean and closing the door, but said the task was overlooked and that he had not yet come across the waste disposal policy. The ADM stated maintenance personnel were responsible for keeping the dumpster area clean and closing the door, with the MS monitoring the task, and also stated she did not know why the area was littered with garbage or why the door was not closed. Record review of the facility policy titled Sanitation, revised November 2022, stated garbage and refuse containers are to be in good condition, waste properly contained in dumpsters/compactors with lids or otherwise covered, and garbage disposal areas maintained to prevent pests.

The facility policy titled Waste Disposal indicated regulated waste disposal shall be placed in closable leak proof containers and that waste containers should be replaced routinely and not allowed to overfill.
