The record review showed that the arbitration agreements were signed by the residents and either the AC or MKD as facility representatives. Despite the facility's intent to resolve disputes amicably, the lack of proper explanation and understanding of the arbitration agreement led to residents signing without full awareness of their rights and the binding nature of the agreement. This oversight in communication and documentation contributed to the deficiency identified by the surveyors.
